Search and Seizure: A Nonprofit Health Care Agency Stands Up to Government Agents

Beverly Withrow

Barlow Herget

A government search and seizure can be devastating to a home health care business, but do not assume that government agents always follow the law. Government agents make mistakes too. This article describes an actual search and seizure, its flaws, and the fight by the target company to win vindication. The article details how the company remained in business after losing an estimated 5 million documents including records and charts. The article also offers advice about actions one can take in the event of such a search and seizure.

Key Words: home health care • hospice care, Medicare fraud • Medicaid fraud, search and seizure
